Прокуратура хочет забрать землю киевского ботсада у детей неизвестного Тофика

Прокуратура Киева опротестовала 12 решений Киевского городского совета о передаче в частную собственность физическим лицам земельных участков для строительства жилых домов на переулке Бастионном в Печерском районе Киева.

Об этом сообщила пресс-служба прокуратуры Киева.

Указанные решения Киевсовета были приняты с нарушением закона. В частности, во время отвода земельных участков не был разработан и утвержден детальный план территории района, как этого требуют статьи 12 и 13 закона «О планировании и застройке территории» и статья 17 закона «Об основах градостроительства».

Кроме этого, на каждом из 12 земельных участков по актам обследования зеленых насаждений растет в среднем 50 деревьев и 20 кустов, которые подлежат сносу. Согласно закону «О планировании и застройке территорий», строительство объектов жилищно-гражданского назначения за счет территорий парков, скверов и зеленых зон общего пользования запрещается.

Кроме этого, переданные в частную собственность земельные участки находятся рядом с территорией парка-памятника садово-паркового искусства национального значения (Национального ботанического сада им. Гришка Национальной академии наук), территория охраняемой зоны которого еще не определена Киевсоветом.

При этом указанные земельные участки находятся в зоне охраняемого ландшафта и центральном историческом ареале, где не разрешается какое-либо строительство, которое негативно влияет на характер ландшафта, а проектирование новых жилых районов, промышленных и других объектов вообще исключается.

По результатам рассмотрения протеста будет решен вопрос об обжаловании актов о праве собственности на указанные земельные участки в судебном порядке.

От «Обкома»: Как уже сообщалось (см. Киевсовет отдал бесплатно землю у ботсада каким-то Тофиковичам), в августе Киеврада устроила массовую раздачу земли. Столичные депутаты бесплатно выделили 32 участка физическим лицам. Из них 12 участков по Бастионному переулку, прилегающему к территории Центрального ботанического сада, отдали под строительство коттеджей.

По оценке члена правления Ассоциации специалистов по недвижимости Юрия Базилевского, земля по Бастионному переулку стоит от 100 до 150 тысяч долларов за сотку. Таким образом, общая стоимость розданных киевской властью участков возле Ботсада — 100-150 миллионов долларов.

Примечательно, что из 12 человек, получивших землю возле Ботсада, трое имеют довольно редкие отчества — Тофиковна, Тофикович.
